Quiero en esta oportunidad manifestarme con la mayor contundencia, no como un quejoso que se lamenta por los flagelos habituales de la vida, más aún en un claustro penitenciario, sino con la verdad absoluta del facilismo del sistema, de la mediocridad de los jueces y de la indiferencia de los demás funcionarios del aparato judicial o como prefiero llamarle, el aparato punitivo.

Es cierto y como evidencia resultarán como las próximas pruebas que estoy por revelar al planeta que la prisión para una gran mayoría de los países, expresándome desde la experiencia penitenciaria en Latinoamericanos, que estos espacios son lo que la sociedades, enmascarando en lugares para la presunta reinserción social son ciertamente los basureros para los seres humanos, los lugares donde la sociedad deposita y desecha a las personas que no les sirven al sistema y a la sociedad.

Dentro de los penales en Latinoamérica existen retenidos un porcentaje de personas inimputables; este término se usa para determinar aquellas personas que por sus condiciones psicológicas, mentales o psiquiátricas, no tiene las facultades cognitivas promedio de un ser humano y que su razonamiento se encuentra por debajo del común denominador de la población, por lo tanto no gozando del discernimiento suficiente para proceder con la coherencia y contundencia suficiente para la toma de decisiones con alguna intención, en este caso delictiva. Dicho esto significa que hay personas con deficiencias cognitivas que cometen actos delictivos sin ser conscientes a plenitud de lo cometido.

Ante esto la normativa les ha clasificado como personas inimputables, o sea personas que están imposibilitadas para imputárseles o achacarles la comisión de delitos dadas sus cualidades mentales, por lo tanto a pesar de la comisión de estos, ellos no deberían ir a un centro penitenciario en ningún momento, tal vez con la mayor coherencia los jueces deberían someterles a ser tratados médicamente para mejorarles en sus patologías.

Más sin embargo esto no sucede en los países Latinoamericanos, los jueces no entiendo cómo al tener a los inimputables en sus estrados, no comprendo como no han sido capaces de identificar a todos los inimputables con los que diariamente he tenido contacto por tantos años de cautiverio. Yo no soy un psicólogo, pero no necesito serlo para identificar a un ser humano que carece de atención y cuyas simples formas de moverse, observar, interactuar y responder no cuentan con todas las características habituales de alguien promedio. Ahora es cuando me pregunto ¿Cómo es posible que durante una audiencia pública ante un juez, que por cierto siempre predominan ser muy prolongadas, estos no han sido capaz de identificar su inimputabilidad? Como mínimo creo que con el título de abogado que debe ostentar un juez, la actuación apropiada debería ser ordenar al cuerpo investigativo de médicos forenses del Estado de calificar las cualidades cognitivas del sujeto indiciado para saber como debe como debe darse continuidad al respectivo proceso. Entonces ante un proceder ajeno a lo mencionado como no llamarles mediocres, permitiendo que un proceso continúe ante la evidente discapacidad mental del procesado.

Y continuó cuestionándome ¿Cómo es posible que ningún funcionario de con los que tiene contacto o de los eminentes profesionales que se presentan para una audiencia pública, como fiscales, procuradores y demás, ninguno sea capaz de percatarse de la inimputabilidad del procesado? Ciertamente solo puedo tildar de indiferentes ante lo sucedido, conocedores de lo sucedido pero impulsados por el común proceder del sistema que según los hechos es evidente que no les importa que el sujeto reciba lo que verdaderamente necesita, ya sea un proyecto para reinserción social o atención médica especializada, sino que parece que lo importante es lograr el papeleo necesario para legalizar el como deshacerse de este ser humano, sin importar su paradero, solo que ya no estorbe en el funcionamiento habitual y promedio del sistema social.

¿Creen ustedes que después de esta evidencia donde demuestro que un aproximado del 5% de la población privada de la libertad ha sido procesada de forma mediocre e indiferente solo con el fin de deshacerse de estos?

Estos hechos son una muestra de la ausencia de humanidad del aparato punitivo, también de que la sociedad toda en conjunto procede de una manera deplorable, mirando hacia otro costado para no hacerse cargo de quienes necesitan su atención, sobre todo esto debido a que en algún momento las personas acá puestas como evidencia, han padecido el abandono en algunas formas, porque si previamente estas hubiesen recibido la atención debida, muy posiblemente los hechos delictivos acontecidos, se hubieran prevenido. 

La privación de la libertad es el resultado de un intento de solucionar los desastres que el Estado ha hecho con la sociedad cuando no le ha cobijado con los derechos mínimos a la población, logrando que estos individuos en abandono solo intentan sobrevivir como sea que les sea posible, en la mayoría de los casos. 

Me gustaría como conclusión aportar esta manifestación como amonestación primaria a los funcionarios del aparato y la sociedad en general para que dialoguemos y actuemos en favor de las personas que no tienen las cualidades para hacerlo y que simplemente deben padecer los tortuosos tratos que se les impone, digo esto porque he sido testigo de cómo los inimputables padecen una existencia en constante flagelo dentro del presidio, donde son sometidos a todo tipo de actos indignos solo por la diversión de algunos inconscientes. 

¡Que este tipo de retención en algún momento no suceda más! 



English translation:

I want to take this opportunity to speak out with the utmost conviction — not as someone lamenting the habitual afflictions of life, especially in a penitentiary environment, but with the absolute truth about the ease of the system, the mediocrity of judges, and the indifference of other officials within the judicial apparatus (or, as I prefer to call it, the punitive apparatus).

All of this is true; and as evidence, I will present, below, proof to the world that prisons, in the majority of countries — as one speaking from the penitentiary experience in Latin America — are what societies disguise as places for alleged social reintegration but are, in fact, dumping grounds for human beings. These are spaces where society deposits and discards people who are no longer useful to the system or to society.

Inside prisons in Latin America, a percentage of detainees are deemed inimputables (“unaccountable”). This term is used to describe individuals who, due to their psychological conditions, lack the average cognitive faculties of a human being. The reasoning of these ‘unaccountable’ people falls below the common denominator of the population, rendering them incapable of sufficient discernment to make coherent and intentional decisions — in this case, criminal decisions. This means that individuals with cognitive deficiencies commit criminal acts without being fully aware of their actions.

Given this, legal norms classify these individuals as unaccountable, meaning they cannot be charged with or blamed for committing crimes due to their mental conditions. As such, despite the acts they have committed, they should never be sent to a penitentiary. Logically, judges should mandate medical treatment to improve their pathologies.

However, this often does not happen in Latin American countries. Judges, when confronted with unaccountable individuals in their courts, fail to identify them. After years of captivity and interacting daily with these individuals, I cannot comprehend how judges have not been able to recognize unaccountable individuals. I am not a psychologist, yet I do not need to be one to identify a human being who lacks the capacity to pay attention to their surroundings, and whose basic mannerisms — how they move, observe, interact, and respond — clearly differ from those of the average person.

So, how is it possible that during a public hearing before a judge — which can be very prolonged — they fail to identify the unaccountability of such individuals? At the very least, with their law degree, a judge should order the state’s forensic medical team to assess the cognitive faculties of the accused to determine how the process should proceed. Given the failure to do so, how can one not call them mediocre for allowing a process to continue despite the evident mental disability of the accused?

Furthermore, I question how it is possible that no other officials — whether prosecutors, public defenders, or other professionals present at a public hearing — notice the unaccountability of the accused in these circumstances. I can only describe their actions as indifferent. They seem to be aware of the situation, but are driven by the system’s common practices, which clearly do not care whether the individual receives what they truly need, whether that be a social reintegration program or specialized medical care. Instead, the priority appears to be completing the necessary paperwork to legally dispose of this person, regardless of their fate, so long as they no longer hinder the system’s normal operations.

Do you believe that incarcerating this population, which has been processed with mediocrity and indifference just to dispose of them, is acceptable?

These facts showcase the lack of humanity in the punitive apparatus and reveal how society, as a whole, acts deplorably — turning a blind eye to avoid responsibility for those in need of attention. Many of the individuals I have interacted with have experienced abandonment in one form or another. Had they received proper care earlier, the crimes they committed might have been prevented altogether.

Incarceration is the result of an attempt to address the disasters the state has created by failing to provide even the most basic rights to the population, leaving these abandoned individuals to survive by any means necessary, in most cases.

In conclusion, I present this statement as a primary admonishment to the officials within the apparatus, and also to society as a whole in the hopes that they will engage in dialogue and action for those who lack the capacity to advocate for themselves. These individuals are forced to endure the torturous treatment imposed upon them. I say this because I have witnessed how the unaccountable suffer a constant state of abuse within prison, subjected to all kinds of indignities for the amusement of a few.

Let this kind of detention cease to exist!
